Definitions
1.1 The 'Company' refers to Spanish Teachers UK, or Spanish Students UK, or Spanish Solutions Limited.
1.2 'The client/student' refers to the person in whose name the booking is made and will include the person or persons on whose behalf the same is made.
1.3 'Force Majeure' refers to any event outside the Company's control which prevents the prompt performance of its obligations, including war and civil strife, etc.
1.4 Tutor refers to the person in charge of the teaching of Spanish.
Acceptance and acknowledgement of these terms
2.1 These Terms of Business are between Spanish Solutions Ltd and the Client.
2.2 The knowledge of the existence of these terms and conditions is exclusively the responsibility of the client and they are considered as understood and accepted once the client has agreed with the company to take part in the first free class independently, if after the realisation of this they decide to continue with the tuition process or not.
2.3 If the client decided not to continue following the free lesson offered by Spanish Solutions Ltd, the client would be liberated entirely from the totality of the clauses of this contract apart from that of number 7.2 and 7.2.1. These clauses remain in effect for a 12 month period which begins in the instant that the client makes their first booking, or from the last class to have been taken by the client if they have acquired a package of lessons.
2.4 The purchase of a package of lessons or any of the other services offered also implies the acceptance of each and every one of the clauses of these terms.
Our services
3.1 Spanish Solutions Ltd offers a private Spanish teaching service or hours to be carried out in a pertinent location which is mutually convenient both for the teacher and the student. Generally this means the house or office of the client.
3.1.1 The time and date of the classes should be
agreed upon mutually between the student and tutor, and these should
be worked out according to the following time frame: from Monday to
Sunday between 9am and 8pm.
3.1.2 Once the date, time and place in which the classes will take
place have been arranged, these can not be unilaterally modified
unless this is done through another agreement between the client and
the assigned tutor. In the case of no verbal agreement, the classes
should be continued in the same way as they were carried out before.
3.2 Our telephonic conversation class service, described on our website, is regulated under the same criteria as our private tuition service, with the particularity that for this service, no physical meeting between the client and the tutor is required, due to the telephonic nature of the class.
3.3 The translation service described on our website also largely conforms to these terms and conditions, and moreover, it adds the following points:
3.3.1 Once the translation process has been completed by one of our professionals, the client does not have the right to refund for the service used. The contracting of this translation service implies acceptance of this clause and the remainder described in these terms and conditions.
Rights of the Client/Student
4.1 The student has the right to apply to this company for a change of tutor if they consider that the tuition process fails to meet their expectations.
4.2 The student can choose the educational mode which best suits their interests and has complete freedom to decide/modify the academic content of the class.
4.3 All of the students have the right to participate in the free conversation classes, the so-called Tapas-Class, when this type of class is organised.
4.4 The student has the right to propose the place, date and hour of the classes, but this agreement should involve a consensus with their personal tutor in order to arrange a meeting.
4.5 All of the students have the right to obtain a free class for every two new students (referred by them) who make use of the personal tuition service of this company and have acquired at least two lesson packages.
4.6 The student has the right to stop their tuition process for a 6 month period if they have cause to. After this period, any pending lessons will be automatically cancelled.
Rights of this Company
5.1 This company reserves the right to accept, limit or decline requests for the services offered where and with whom we see cause to.
5.2 This company has the right to decline a change of tutor if:
There are no other teachers that work in the area.
None of the teachers who work in the area wish to take charge of the client.
If this company understands that this change of teacher is not based upon a purely academic qualm.
5.3 Although this is not usual, and we do not advise so to our administrative staff, this business reserves the right to change the client’s teacher if necessary. The client understands that the purchase of classes does not link the consummation of these tuition hours with a specific tutor but with whichever tutor the company sends.
The company’s obligations
6.1 Once the client has acquired a package of classes, Spanish Solutions Ltd is committed to providing the service that the student/client has contracted, following the steps described in these terms, and published on our website.
6.2 Spanish Solutions Ltd is committed to provide a personal tutor who materialises the tuition hours acquired by the client previously as long as there is no major factor impeding them from adhering to this commitment.
Obligations of the students
7.1 The client is committed to the registration, in writing, with their name and signature, of all the hours that are covered in their classes in order to create a memorandum of all the hours that have been completed.
7.2 The client/student is forbidden to set up/propose or insinuate unilateral agreements other than those already contracted, as well as any other Spanish-related service with the assigned tutor other than those already contracted, in any way; neither after the first Free lesson nor after this, or in any other time throughout the learning process, or in the 12 months which follow the student’s last class. The student understands and respects that:
The assigned tutor is a worker employed by Spanish Teachers UK and is not self-employed, or working under any other account, and therefore any money paid to the teacher which eludes the agreement made on contracting the services of this company is classed as black money, not declared publicly, contravening British law, and therefore is against these terms and conditions, and moreover against the interests of this company.
7.2.1 In the case of the client not respecting clause 7.2 and deciding to break this, they will be subject to a fine of 750 pounds in compensation to this company.
Payments
8.1 The first free class which we offer will not, under any circumstances, be charged, whether the client decides to continue with our services or not.
8.2 The payment of your classes should be carried out directly to Spanish Solutions Ltd, online, through www.spanishstudents.co.uk, by electronic invoice, or by cheques in the name of this company.
8.3 The client accepts the payment methods proposed by Spanish Teachers UK.
8.4 The price of the lesson packages has a final raise of between 3% and 4% due to concepts derived from the electronic payment fee (Tax).
8.5 The price of the tuition per hour may be modified without previous warning by the executive body of Spanish Solutions Ltd and this modification will apply only when purchasing new lesson cycles.
8.6 Once a package of lessons has been purchased, Spanish Solutions Ltd cannot give any kind of refund, be it total or partial, for the service acquired. If, after the purchase, the client decided to change their mind and wished to cancel the classes before or after beginning them, they would not have the right to a refund to the fees paid, understanding that the tuition process contracted begins the instant that the purchase is made, and ends when the lesson cycle has been completed, or the student has decided not to continue with the lessons.
8.7 The client understands that the purchase of their lesson package does not imply that these should be covered by a specific tutor.
Changing and cancellation of classes
9.1 In the case of a client deciding to cancel a class already arranged with their personal tutor, the client should warn the tutor within 24 hours time. In the case of not informing the tutor within this time margin, Spanish Solutions Ltd could choose to class the lesson as completed, depending on whether the cancellation has affected in any way the interests of the tutor. The client accepts that the service for which they have paid, personal tuition sessions, begins at a minimum of 24 hours before the preparation of the lesson that their tuition hours imply.
9.2 In the case of the client deciding to cancel the course that they are taking par in without having completed the lessons cycle that they have purchased, Spanish Solutions will not refund the cost of these classes which the client has given up with.
9.3 With the aim of giving flexibility and a margin of action to the clients, this company can freeze your course for a period of 6 months if, for work-related reasons, illness or any other issue, the client decides to put their tuition process on stand-by. If after making official this cancellation request (sent via e-mail) we do not receive notification to continue with the booked classes in the next 180 days, the service will be cancelled and you will be denied the right to complete the rest of the course.
Sessions
10.1 Once the client has acquired a lesson package to carry out their educational process, they understand that the duration of the tuition sessions should be spread according to the criteria described below:
a) One-to-One lessons: A minimum of 2 hours per weekly session.
b) Two-to-One lessons: A minimum of 2 hours per session per week.
c) Mini groups lessons: A minimum of 1 hour per week.
Legal Liability
11.2 The breaking of any other clause of this contract, or any flair which goes against the cordial nature of this contract could result in the unilateral cancellation of the service.
